The CameroonianPenal code criminalizes sex work though article 343 of the penal code. Itstates: (1) shall be punished by imprisonment of six months to five years termsand a fine of 20,000 to 500,000 francs, anyone (regardless of this sex).
Who regularlysell sexual services to others ,(2) shall be liable to the same penalties he/she who, for purposeof prostitution or debauchery shall publicly by gestures, words, writing or anyother means ,solicit persons of either sex.
Despite a legalframework that criminalizes prostitution, it has not been reported cases of SWswho have been tried and punished under Articles 343(new).It is therefore a caseof a practise prohibited by law but tolerated by the authorities and thepopulations. But, SWs are still exposed to certain risks in the performance oftheir business.
During policeverification, SWs are sometimes arrested, often on the grounds of not havingidentification card. But there are often released after payment of a sum ofabout 3,000 francs CFA. In some cases, these SWs are victim of sexual abuse(rape) or forced to have unprotected sex for a release. The most affected bythis situation are mobile SWs than fixed (receiving clients at home).SWs aswell as MSM are victims (in a lesser extent) of stigmatisation, discrimination,or breach of confidentiality in health care facilities.
Ultimately, asfar as the situation of human right in Cameroon is concerned, it is reported (Minjustice 2010 Report) 25 investigations, 25 prosecutions, 14 cases statementsand 9 sentences for prostitution in Cameroun.
There have beenmany improvements during recent years in Cameroon, including thedecentralization and free access to antiretroviral, drugs, the epidemicstabilizing, funding for programs targeting most at risk populations.
But SWsdeplore the absence of specific actions toward their male and transgender colleagues.They recommend that programs against targeting sex workers be more inclusiveand take into account their differences. They need appropriate preventionmaterial on and STLs, as well as appropriate and non- stigmatizing services.
Thevulnerability’s factors of sex worker in Cameroon is: persistent poverty, socialexclusion, teenage mothers, school exclusion, absence marital or familyprotection, weakness of other systems of protection, single parent ,poor accessto prevention ,to treatment and care, stigma and discrimination.
The risk’s of this factor is: multi sexualpartnership, unprotected sex, sex precocity, high prevalence of and STLs, low power for safe sex negotiation, anddrug use...
